Biography

Michael has handled a wide range of complex commercial claims in state and federal courts in New York, Delaware, Connecticut, New Jersey, Florida, Texas, California and Illinois, and has represented a diverse range of domestic and international private and public companies, and their directors and officers in their most crucial litigation matters. He has also practiced before the AAA, JAMS and ICC, and advised clients in a wide range of industries, including financial services, artificial intelligence, cybersecurity, cryptocurrency, cyberthreat intelligence, government contracting, chemicals, manufacturing, energy, aviation, automotive, health, construction, private equity, telecommunications, sports and real estate.

Before becoming an attorney, Michael served as an intelligence officer with the Defense Intelligence Agency and the Office of the Director of National Intelligence. He covered Russian foreign policy towards Asia and the Middle East, wrote for the President’s Daily Brief and provided intelligence support to policymakers and warfighters. Michael also built the Intelligence Community Joint Duty Program that was recommended by the 9/11 and WMD Commissions, mandated by the Intelligence Reform Act of 2004, and ultimately recognized by Harvard University as one of the most innovative government programs in America. Michael is routinely sought after to speak and provide counsel on national security matters.

Michael has represented, among others:

  • Wakem Capital, a cryptocurrency asset manager in an arbitration before the ICC concerning a cybersecurity breach and theft.
  • A private equity firm in connection with disputes arising from a nine-figure investment in a construction project in New York City related to the EB5 Visa immigration program.
  • Multiple aviation companies in a multi-million dispute arising from a purported loan default before the New York Supreme Court, Commercial Division.
  • The former CEO of Rockwood Holdings, and other directors and officers of Rockwood Holdings, a worldwide chemical company, in a AAA arbitration and related proceedings in the New York State Supreme Court, Commercial Division, arising from claims of fraud, breach of contract and more against the Huntsman Corporation and securing a complete dismissal of claims.
  • GardaWorld, a provider of security services, in connection with a dispute involving complex accounting and earnout dispute issues that arose from a purchase and sale agreement, and addressing related issues concerning representations and warranties insurance, before the New York Supreme Court, Commercial Division.
  • Quinenco S.A. and Tech Pack S.A. as sellers in a nine-figure post-closing dispute involving nearly 30 different claims for indemnification related to the acquisition of manufacturing facilities across Latin America.
  • The National Hockey League in a complex insurance dispute arising from the concussion litigation that involved lost insurance policies.
  • Harland Clarke Holdings and the Scantron Corporation in post-closing dispute arising from the nine-figure acquisition of a software company before the District of Delaware.
  • Goldman Sachs and other underwriters in connection with a securities class action arising from the IPO of GoHealth, a health insurance marketplace.
  • Patrick Drahi, the Chairman of Altice, in connection with executive compensation matters in the Delaware Court of Chancery.
  • Citibank, in connection with a dispute with Barclays related to losses from FX trading in the Southern District of New York.
  • Various employees and employers in disputes pertaining to non-compete and non-solicit agreements.
